The Natural Resources, Transportation, and Indigenous Legal Group, Indigenous Legal Relations, Barrister Unit is recruiting one PEA Legal Counsel 3 (12+ years call) for a regular, full-time position.

Indigenous legal issues affect nearly all aspects of Crown conduct, and British Columbia is at the forefront of these issues in terms of Court decisions, policy development and the reconciliation of Aboriginal and Crown titles and jurisdiction. Since the Constitution Act, 1982 (section 35), Aboriginal law in Canada has developed at a considerable pace. For over 20 years, Legal Services Branch has maintained a dedicated team of lawyers providing clients with trusted, thoughtful advice and representation in this highly specialized and critical legal area.


The successful candidate must be able to work independently and collaboratively within litigation teams. Responsibilities include conducting Aboriginal rights and title litigation, judicial reviews, tribunal hearings, and appeals at all court levels. The role involves appearing as counsel (independently or co-counsel) for the Province or statutory decision-makers, as well as conducting legal research, drafting pleadings, applications, arguments, and factums, and managing large volumes of documents. The position also requires developing specialized expertise in Aboriginal law, monitoring legal trends, responding to emerging claims, and providing regular updates to clients.


Applicants must demonstrate current knowledge of Aboriginal law, or constitutional and/or administrative law, including familiarity with the Declaration on the Rights of Indigenous Peoples Act, the Province’s Draft Principles for relationships with Indigenous Peoples, and the Truth and Reconciliation Commission’s Calls to Action. Strong organizational, written, and oral communication skills are essential, along with the ability to manage competing priorities and work collaboratively.

Qualifications for this role include:

  • Eligibility for Membership in the Law Society of British Columbia
  • Level dependent on years of call (12 years of call or more for Legal Counsel 3)
  • Significant and current civil litigation experience, including the conduct of actions, petitions and applications
  • (Significant and current civil litigation experience is defined as the experience normally associated with a lawyer whose primary position and role throughout the four years preceding their application has been as litigation counsel and who have led the conduct of litigation or have been an active member of a litigation team)
